MegaPath Terms and Conditions

MegaPath sells its DSL and ISP Services to you subject to certain Guarantees and to the following Terms and Conditions. "We" in this document refers to MegaPath; these terms are set by MegaPath and as published on our web site are subject to change without notice.

Cancellation Prior to Installation

Within minutes after you place your order with us, it is electronically transmitted to our DSL vendor and to the telephone company that provides the actual wires between your site and your nearest central office. Within two or three days these companies start incurring significant costs on your behalf: pulling engineering drawings, identifying and testing circuits, etc. If you then cancel your order, they charge us for these costs. In order to keep costs for all our customers to a minimum, we therefore have to impose a $147 Cancellation Fee if you cancel your order prior to installation.

This Cancellation Fee will be waived if any of the following occur:

  1. You cancel within 3 business days of placing your order.
  2. We cannot provide you with DSL service operating at the speed you have ordered, and you cancel within 3 business days of being informed that we cannot do so.
  3. We cannot install your DSL service within 50 days after we accept your order, and you choose not to wait for us to complete the installation.

Deactivation Reimbursement

All the vendors involved in providing you with DSL service make a considerable investment in installing your line, an investment that is amortized over years. If you choose to deactivate your service in less than a year, we have to reimburse our partners for some of their unrecovered installation costs. Again to keep costs for all customers to a minimum, we therefore have to impose a Terminaton Fee if you choose to terminate your service at any time within the first year after installation is complete. You are under no obligation to retain your DSL service for any fixed or specific period.

This Deactivation Fee will be waived if any of the following occur:

  1. You deactivate service due to a move but order DSL service from MegaPath for your new location at the same time as the deactivation order.
  2. Your DSL service is inoperative or unable to transport data reliably at the speed you accepted at the time of installation for a period of more than 20 business days after you inform us of the problem, and you then choose to deactivate.

DSL Service Changes

Increases in DSL speed: no charge if the speed increase can be made without changes to your router or an on-site visit. If you need a different router or we have to make an on-site visit, then we reserve the right to impose a charge to cover such costs; we will inform you of such charges before making any changes.

Decreases in DSL Speed: $100 Service Change Fee if the speed reduction can be made without changes to your router or an on-site visit. If you need a different router or we have to make an on-site visit, then we will charge you to cover such costs; we will inform you of such charges before making any changes.

Move DSL Location:No charge for first move in any 12-month period. We reserve the right to impose a $150 Relocation Fee if you make more than one move within a 12-month interval.

Invoicing and Payment

No charges are imposed until your installation is complete, unless you cancel in which case the Cancellation Fee may be due. Any charges for installation, routers, etc. are made when installation is complete. DSL service is billed monthly in advance and payment is due on the first day of your billing month (your billing month typically starts on the day your installation is complete, e.g. if your installation was completed on the 17th of the month, then your payment will be due on the 17th of each month thereafter.)

SOHO DSL Service: Invoices are emailed, and payment can be made via automatic charge against a credit card. If required, a printed invoice will be sent via US Mail; a $5 per month fee will be charged for this service; however, payment must still be made via credit card.

Business DSL Service: Invoices may be emailed or printed and sent via US Mail. Payment may be via check or credit card; if by check, payment must be received within 10 calendar days of the first day of your billing month. Any returned checks are subject to a $15 fee. Orders for Business DSL Service must include a credit card.

If your payment is late or your credit card charge is refused, we will send you notice via email. If we have not received your payment within 10 calendar days after sending you notice, we reserve the right to suspend your DSL service immediately without further notice. If we suspend your DSL service, you have 30 calendar days to reinstate service. In order to reinstate service you will have to pay a $100 Reinstatement Fee plus all outstanding amounts due, including the cost of DSL service during the period of suspension. If you do not reinstate service within 30 calendar days, we will deactivate your DSL service without further notice and any applicable Deactivation or other Fees will become immediately payable.

Acceptable Use Policy

You agree to abide by MegaPath's Acceptable Use Policy as posted on our Web site and amended from time to time.

Warranties On Routers

We do not directly warrant the router or other so-called Customer Premise Equipment (CPE) that you purchase from us. Instead you do receive the original manufacturer's warranty on such equipment. If your router does fail, our Technical Support staff will be glad to assist you in getting it repaired or replaced, whether in or out of warranty.
